This document is an electronic record in terms of Information Technology Act, 2000, and the Rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Swiggy Limited (hereinafter referred to as “Swiggy”, “We”, “Our”, “Us”) reserves the right, at its sole discretion to terminate, amend or extend, modify, add or remove portions of this terms & conditions or this Campaign (defined below), at any time without any prior written notice to You (defined below).

By participating in this activity, all participant User(s)(defined below) agree to be bound by these terms and conditions (“T&Cs”), the Terms of Use, Privacy Policy and other relevant Swiggy policies or documentations that are available on www.swiggy.com and its mobile application (“Platform”) including any modifications, alterations or updates that We make (together “Swiggy T&Cs”).

1. Details of the Campaign: 

We have launched two campaigns mentioned as Campaign 1 and Campaign 2 (collectively “Campaign”), which is commencing from 11 AM on 29th April, 2025 until 8 PM on 29th April, 2025, (“Campaign Period”) [VS1] on the Platform. Every registered Swiggy user (hereinafter referred to as “You”, “Your” or “User”) who meets the pre-requisites set below, subject to and in accordance with the T&Cs, shall be deemed to be a participant in the Campaign.

Campaign 1:

A.   Steps to participate:

            i. Swiggy shall post a tweet on Swiggy’s Twitter page.

           ii. User have to share 4 food images in comments.

B. The Criteria for winning is as follows and shall be referred to as Winner in these T&C’s:

            i. 5 Winners shall be decided randomly without human intervention.

C. Each Winner may, subject to the T&Cs, be eligible to receive ₹500 (“Prize”).

D. The Winners shall be announced within 1 hour from expiry of the Campaign Period. The Winners shall be contacted by Swiggy and the Prize shall be sent by Swiggy to the Winner.  [VS2] 

Campaign 2:

A. Steps to participate:

            i. Swiggy shall post a tweet on Swiggy’s broadcast channel.

           ii. Users have to reply in the comments.

B. The Criteria for winning is as follows and shall be referred to as Winner in these T&C’s:

            i. 5 Winners shall be decided randomly without human intervention.

C. Each Winner may, subject to the T&Cs, be eligible to receive ₹500 (“Prize”).

D. The Winners shall be announced within 1 hour from expiry of the Campaign Period. The Winners shall be contacted by Swiggy and the Prize shall be sent by Swiggy to the Winner.  [VS3] 

2. Relevant terms and conditions:

a.  The Campaign will be active and valid only during the Campaign Period.

b.  This Campaign is valid only for Users in the following locations: PAN India except the state of Tamil Nadu.

c.  It is hereby clarified that, a Winner will only be eligible for one (1) Prize and a User can only be a Winner once during the Campaign Period.

d.  No responsibility is accepted for entries that are late, lost, misdirected or not received by Us during the Campaign Period. Any operating or ancillary costs associated with the Prize are the sole responsibility of the Winners.

e.  By participating in this Campaign, you consent to share your name, email ID and phone number with Us, Our agents, any third parties we may have a tie-up to facilitate this Campaign. In the event You do not provide the aforementioned consent, You shall not be eligible for participating in the Campaign.

f.   The Users understand that We do not make any assurances as to the probability of winning in this Campaign.

g.  We do not collect any participation fees for the Campaign.

h.  To be eligible to participate in the Campaign, You need to also fulfill the following criteria:

                             i.        You are competent to contract as mandated by the Indian Contract Act, 1872 and shall be of minimum age of 18 years;

                           ii.        You shall be in compliance of and adhere to all laws and regulations;

i.   Participation in the Campaign is entirely voluntary, and participation will be construed as an acceptance of the T&Cs.

j.   There is no cash alternative to the benefits hereunder. Further, such benefits do not give any additional guarantee or warranty and are non-transferable.

k.  This Campaign is not valid in the state of Tamil Nadu and for any User from the state of Tamil Nadu. The same shall be a disqualification to the Campaign.

3. We reserve the right to disqualify from the Campaign any User, who, We have reason to believe has breached these T&Cs, Swiggy T&Cs, engaged in any unlawful or improper misconduct  or is in breach of any applicable law.

4. All trademarks, trade names, logos, slogans, symbols etc. being displayed on Our application or website, shall be the exclusive property of Swiggy and cannot be copied or used by any third party for any purpose whatsoever and any unauthorized usage would amount to an “unlawful act” under the applicable law. 

5. Swiggy shall not be responsible for any loss, injury or any other liability arising due to participation by any User in the Campaign, whether direct or indirect.

6. The User understands and agrees that Swiggy is merely a facilitator in this Campaign. Swiggy will not be liable for any losses, damages, claims, actions etc. arising from this Campaign.

7. We assume no responsibility for any technical error, omission, interruption, deletion, defect, delay, loss or damage in the operation of the Instagram app, website/app and/or participation in the Campaign. If for any reason the Campaign is not capable of being run as planned, due to causes beyond the reasonable control of Us, We may modify, suspend, terminate or recommence the Campaign without any further notice.

8. You hereby agree to indemnify and keep Swiggy harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by Swiggy as a consequence of (i) violation of the terms of the T&Cs or any other policy by You; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence on Your part and/or (iv) any third party claims.

9. User agrees (without charge) to participate in any promotional activities planned by Us and consent to their name location, and image being used in Our marketing materials. By participating in this Campaign, User(s) consent to the use of their personal information as set out in this clause and the Swiggy T&C’s. We may, either by our employees, agents or third parties, collect and use personal information submitted with each entry for the purpose of running/promoting the Campaign and/or contacting/announcing the Winners.

10. These T&Cs shall be governed in accordance with the applicable laws in India. Courts at Bengaluru shall have the exclusive jurisdiction to settle any dispute that may arise under these T&Cs.

11. Swiggy reserves the right in its sole and absolute discretion to amend/change/vary any of the terms and conditions for the Campaign at any time without any prior notice. By entering into the Campaign, the User agrees to such amended terms.

12. Under no circumstance shall Swiggy and/or their directors, employees, officers, affiliates or subsidiaries, be liable to the User and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever, even if Swiggy has been advised of the possibility of such damages.
